Senior Strategic Demand & Brief Specialist
Position Overview The Senior Strategic Demand & Brief Specialist is responsible for developing compelling, evidence-based demand packages and legal briefs for Personal Injury claims. This role combines strong legal writing, case analysis, medical record review, and settlement strategy to effectively position claims for maximum recovery.
The adecuado candidate is more than a strong writer—they are a strategic thinker who can analyze complex case information, identify the strongest liability and damages arguments, recognize potential weaknesses, and translate extensive documentation into clear and persuasive settlement narratives.
This role works closely with attorneys, case managers, and other legal operations teams to ensure demand packages accurately reflect the facts of each case and support the firm's negotiation strategy.
Key Responsibilities
Demand Development & Case Strategy
- Develop comprehensive demand packages for submission to insurance carriers and opposing parties.
- Review and analyze medical records, medical bills, insurance correspondence, police reports, witness statements, photographs, investigation materials, and other case documentation.
- Identify and organize key facts related to liability, causation, injuries, treatment, damages, and client impact.
- Develop compelling case narratives that clearly connect the facts and evidence to the client's damages and claim value.
- Identify strengths, weaknesses, inconsistencies, gaps in treatment, liability concerns, and other factors that may affect settlement negotiations.
- Assist in developing the overall settlement positioning and negotiation strategy for assigned claims.
- Evaluate case information to determine which evidence and arguments should be emphasized in the demand.
Legal Writing & Brief Development
- Draft persuasive demand letters, settlement briefs, position statements, response letters, counter-demands, and other claim-related correspondence.
- Translate complex medical, factual, and legal information into clear, concise, and persuasive written arguments.
- Develop customized arguments based on the specific facts, injuries, treatment history, liability issues, and damages of each case.
- Conduct ongoing legal and industry research related to Personal Injury claims, damages, liability, medical treatment, and insurance practices.
- Ensure all written materials are accurate, well-supported, professionally structured, and aligned with the firm's standards and negotiation strategy.
- Review and refine existing templates and written materials to improve their effectiveness and consistency.
Negotiation Support
- Prepare written responses to insurance carrier objections, low settlement offers, and challenges to liability or damages.
- Draft counter-demands and counter-offers based on the facts and strategic objectives of each claim.
- Analyze insurance correspondence and adjuster responses to identify negotiation opportunities and potential issues.
- Support attorneys and negotiation teams by providing well-researched factual and written arguments.
- Adapt demand and negotiation strategies based on carrier responses and developments in the claim.
Collaboration & Quality Assurance
- Collaborate with attorneys, case managers, medical records teams, and other departments to obtain the information necessary to develop strong claims.
- Communicate effectively with internal stakeholders regarding missing documentation, case concerns, and strategic considerations.
- Conduct thorough quality reviews of demand packages and briefs before submission.
- Ensure all claims are supported by appropriate documentation and that factual and medical information is accurately represented.
- Assist with reviewing and providing feedback on demand work prepared by less experienced team members.
- Contribute to the development of best practices, templates, workflows, and processes within the Demand function.
Other Responsibilities
- Stay current on developments relevant to Personal Injury claims, insurance practices, medical treatment, and settlement strategies.
- Maintain organized and accurate case documentation.
- Handle confidential client and case information with discretion and professionalism.
- Perform other duties and responsibilities as assigned by the Firm.
Requirements & Qualifications
- 4+ years of experience in Personal Injury law, preferably in a pre-litigation or settlement-focused environment.
- Proven experience drafting Personal Injury demand letters and demand packages.
- Strong understanding of Personal Injury claims, including liability, causation, medical treatment, and damages.
- Demonstrated ability to review and synthesize large volumes of medical and case-related documentation.
- Exceptional written communication and legal writing skills.
- Strong analytical and critical-thinking skills with the ability to identify the most relevant facts and arguments in a case.
- Experience drafting counter-demands, response letters, settlement briefs, or similar negotiation documents.
- Strong attention to detail and commitment to accuracy.
- Ability to independently manage multiple claims and meet deadlines in a fast-paced environment.
- Strong organizational and research skills.
- Ability to communicate effectively and collaborate with attorneys and cross-functional legal teams.
Preferred Qualifications
- Experience working directly with insurance carriers or adjusters.
- Experience with Personal Injury case management or pre-litigation operations.
- Experience analyzing settlement offers and developing counterarguments.
- Familiarity with medical terminology, treatment documentation, and common Personal Injury damages.
- Experience mentoring or reviewing the work of junior legal writers or demand specialists.
- Familiarity with legal case management systems and digital legal research tools.
- Bachelor's degree in Legal Studies, Paralegal Studies, English, Communications, or a related field is preferred.
What Success Looks Like The successful candidate is able to take a complex Personal Injury file and independently transform the available evidence into a clear, persuasive, and strategically positioned demand. They understand not only how to write the demand, but also what arguments to make, which evidence matters most, where the claim may be vulnerable, and how to position the case for effective settlement negotiations.
